
TERMS & CONDITIONS (last
amended 22 January 2010)
1. SALES RESTRICTION
Sales of our products are currently restricted to UK only.
2. PRICES The prices
quoted are the full UK price. On some components a tiered pricing policy is
applied for example:-

Groupset prices may be discounted (i.e. less than the sum of
the component prices).

Selected components, when applied to complete bike builds,
may be charged at a lower price.
This policy is intended to pass on any purchasing economies to
the customer and enhance value for money.
Errors and omissions are excepted and we reserve the right to
revise prices without notice. If new stock ordered to satisfy a specific order
is of significantly higher cost to Velomax then the customer may be advised of a
price change. If advised of such a change the customer may decide whether or not
to proceed with the purchase.
3. DELIVERY CHARGES
A delivery charge of £2.50 is applied to all orders, in addition
the following items have a delivery supplement applied - bikes £13 ea., frames
£8 ea., wheels £5 pr, home trainers £7 ea. and rims £3 ea. or where otherwise
stated against specific items.
Our delivery service is provided on the basis of a separate
contract from the sale of the main product or service.
4. ONLINE PAYMENT
Payments are accepted on Maestro (Switch), Solo, Electron, JCB,
Mastercard, Visa, Visa Purchasing and Visa Delta. During the payment transaction
you will be connected to the WorldPay secure site, WorldPay has a world-wide
reputation for secure credit card transactions. We at Velomax do not receive
details of your credit or debit card it stays within WorldPay.
5. DELIVERY
LEAD-TIME
Our target is to have orders delivered to customers within 7
working days of receipt of your order, this is based on the assumption that the
customer supplies "Alternative Delivery Instructions" when placing an order, for
large or bulky items the alternative insructions should include the ability to
obtain a signature. Without this information we are restricted in the range of
carriers that we can use and our target is extended to 10 working days.
Deliveries of heavy or bukly packages to Northern Ireland, Isle
of Man, Isle of Scilly and the Highlands and Islands of Scotland may take up to
3 days longer.
When "custom" components or builds are ordered the lead-time can
be influenced by various factors, but we would aim to achieve despatch within 15
working days of order. If, prior to the commencement of work, we establish there
is likely to be a significant delay over this target, we will inform you of our
revised estimated lead time to enable you to make a decision on whether to
proceed with the purchase.
6. DAMAGE AND SHORTAGES
Any damage to the packaging or products which is evident at the
time of delivery must be advised to the carrier when signing for the
package.
The customer must inform Velomax of any damage or shortages
within 24hours of receipt of the package, notification must be in writing and
may be sent by e-mail to admin@velomax.co.uk or by post to the address in the
CONTACT US section of these Terms & Conditions.
If your delivery instructions request goods to be left
unattended or where a signature of receipt cannot be obtained, then the carrier
and hence Velomax cannot accept any claim for damaged or missing goods.
7. INFORMATION AND
IMAGES
Our objective is to provide high quality information and images
to assist you with purchase decisions, we do not however provide advice or
endorse products.
Product weights are quoted wherever possible, in general this is
based on manufacturers' figures which are usually quoted as a single weight for
a range of sizes (e.g. a stem may be quoted as 120g but be available in sizes
from 100 to 140mm). The weight information is therefore supplied to enable
comparisons between products to be made and does not form part of the sales
contract. Every effort is made to keep the images and specifications updated
in line with the latest products, however manufacturers are constantly
implementing product improvements and changes and we will attempt to supply the
latest specification available to us.
8. PRODUCT COLOURS
Where product colours are shown on this website they are
intended as a broad representation only as the reproduction of images does not
allow exact colour representation to be made. On products were colour
matching is offered all reasonable effort will be made to match the colour as
closely as possible but the process employed is not exact and some variation may
occur. Such variation does not constitute reason to cancel the contract.
9. TITLE OF GOODS
The goods shall remain the seller's property until payment has
been received in full, however responsibility for the goods shall pass to the
buyer on delivery. In the event of failed or incomplete financial transactions
the buyer will be responsible for full payment for goods and services or the
return and carriage costs of goods in new condition.
10. RETURN OF GOODS
With the exception of goods that are built to order, customers
have a 7 working day cooling off period during which time goods may be returned
for exchange or refund. The customer must provide written notification of the
return of goods, other than warranty claims, within 7 working days of receipt.
This notification may be sent by e-mail to returns@velomax.co.uk or by post to
the address detailed in the CONTACT US section of these Terms and Conditions.
The goods must be received by us unused and in as new condition in the original
(undamaged) proprietary packaging to ensure that the products can be resold.
The customer is responsible for the cost of returning
goods. The goods must be accompanied by the delivery note number, customer's
name, address and telephone number (we will need to contact you for credit card
details for refunds). If the returned goods were a part of a special offer
(including tiered pricing, vouchers or incentive scheme), at our discretion, we
will take account of whether the basis of that offer is still valid and adjust
refund prices accordingly.
Goods built to customer specification (e.g. "custom" components
or builds*) are not eligible for exchange or refund once work has commenced. *
Where customers have the ability to select components for the build of a bike or
hand-built wheels, this counts as a "custom" build, any build specification
quoted in this website is intended to assist the customer with the selection and
pricing activity and does not constitute a standard specification or stock
build. For the avoidance of doubt, unless otherwise stated all bikes and
hand-built wheels are "custom" build.
We will make every effort to achieve the target lead-time for
"custom" items, but once work has commenced late delivery will not constitute
cause for cancellation of the order.

11. LIABILITY
Our total liability for any claim howsoever arising shall not
exceed the price of the goods supplied to the customer excluding delivery.
12. PRIVACY
POLICY
We collect the base information necessary to
provide the products or services you request, including your name, address,
telephone numbers and e-mail address. We will also keep details of products
purchased and collect any other details you choose to provide to us. The
base information will be used to enable us to provide the best possible service
and to check customer satisfaction. We may use your information to advise you by
suitable media of new products, services, offers etc. By use of this site you
are consenting to receiving such information, you may however opt out by
clicking here To assist us with business development, information on your
methods of accessing this site is automatically collected and used for marketing
and search engine positioning. We do not pass your information on to third
parties but in the event that we sell or dispose of this site the information
may form part of the sale with safeguards regarding the use of the data being
sought from the purchaser.
13. OFFER & ACCEPTANCE
Details of products or services on this site do not
constitute an offer in a legal sense. When you contact us you may offer to pay
for our goods or service and we are free to accept or reject that offer.
14. SEVERANCE
If any parts of this agreement are found to be
unenforceable, void, illegal or invalid they shall be severed from this
agreement and all the other provisions shall remain in force both as to force
and effect.
15. NOTICES
All notices to be served to us shall be given in writing by
pre-paid post or by email at the address detailed in the Contact Us section of
these terms and conditions.
16. AMENDMENTS
This agreement cannot be amended save by our amending
these terms on this page. The date of last amendment is shown next to the main
TERMS & CONDITIONS heading, such amended items come into effect for all
pruchases after this date. You agree it is your responsibility to check here for
any changes.
17. COPYRIGHT
The site is our copyright, all material on it is either our
copyright or that of the manufacturers or supplier that provided it. The site or
any material on it may not be copied, distributed, licensed, or reproduced in
any way whatsoever, save that you are permitted to print or download extracts
from it for personal use only.
18. THE LAW THAT APPLIES
This Agreement shall be governed and construed in
accordance with English Law and the parties submit to the exclusive jurisdiction
of the English Courts.
19. STATUTORY
RIGHTS
The Terms and Conditions of Velomax do not affect customers'
statutory rights.
